These terms apply when you browse kirtechnology.it.com or contact KIR Technology through this website. They do not replace a project proposal, statement of work, or service agreement.

Website information

We aim to keep website information accurate and useful, but it is general information rather than professional advice or a binding service offer. Project scope, pricing, delivery dates, responsibilities, and warranties are agreed separately in writing.

Enquiries, bookings and automated messages

Submitting an enquiry, using the chatbot, requesting a consultation, or receiving an automated email does not create a contract or oblige either party to proceed. Appointment times remain requests until KIR confirms them. Automated messages confirm receipt only and may be delayed, filtered, or unavailable. You remain responsible for checking that important communications have been received.

Service proposals and order of precedence

Paid work begins only after the parties agree the relevant scope, fees, responsibilities, assumptions, and delivery arrangements in writing. If these website terms conflict with an accepted proposal, statement of work, or service agreement, the expressly agreed project document takes priority for that service.

Pricing, payments and third-party costs

Website prices described as "from", estimates, pilots, or starting prices are not fixed quotations for bespoke work. The applicable proposal will state fees, payment stages, taxes, and any third-party licences, hosting, domains, subscriptions, or usage charges. Unless KIR agrees otherwise in writing, customers are responsible for third-party costs and for paying valid invoices by their stated due dates.

Customer responsibilities

You must provide accurate information, timely decisions, lawful content, necessary access, and appropriate backups. You must have authority to instruct KIR and to provide any systems, accounts, repositories, files, personal data, or intellectual property used for the work. Delivery dates may reasonably change where required information, access, approval, or payment is delayed.

Cybersecurity and authorised testing

KIR performs only the activities expressly authorised in the agreed scope. You must own the relevant systems or have permission from their owner to request an assessment. Public configuration reviews and KIR Secure Exposure Scout are passive checks; they are not penetration tests. Vulnerability testing, exploitation, credential testing, or access to private systems requires separate written authorisation, defined boundaries, timing, and rules of engagement.

Security findings reflect the systems, evidence, access, and time available during the assessment. No review can identify every vulnerability or guarantee that a system will remain secure, uninterrupted, or free from attack. Customers remain responsible for operational decisions, backups, incident response, and applying or accepting recommended actions.

Code reviews and repository access

Code-review findings are professional observations within the agreed technologies and scope, not a guarantee that software is error-free, secure, compliant, or suitable for every purpose. KIR will seek the least access reasonably needed. Unless implementation is included in writing, identifying an issue does not include changing the code, deploying a fix, penetration testing, or certifying compliance.

Confidential information and credentials

Each party must use the other's confidential information only for the agreed purpose and protect it with reasonable care. Customers should provide time-limited or least-privilege access where practical and remove KIR's access when it is no longer required. Additional confidentiality, data-processing, or security terms may be agreed for sensitive engagements.

Changes, delays and acceptance

Requests outside the agreed scope may require a revised price and schedule. KIR will explain material changes before proceeding. Project-specific review periods, acceptance criteria, dependencies, and consequences of customer delay belong in the applicable proposal or service agreement.

Cancellations and recurring services

Cancellation, notice periods, completed work, committed external costs, refunds, renewals, and unused allowances are governed by the applicable proposal or service agreement. Website-care or other recurring services continue only on the basis agreed for that plan. Nothing in these terms removes cancellation or other statutory rights that apply to a consumer.

Acceptable use

Do not misuse the website, attempt unauthorised access, interfere with its operation, submit unlawful material, or use automated tools in a way that harms the website or other visitors.

KIR Verify preview

KIR Verify provides automated technical screening of supported files. Its findings and technical-indicator score are not a probability of fraud and do not establish authenticity, authorship, identity, ownership, AI generation, intent, or factual truth. Authentic files may contain flagged indicators, and altered files may pass without a warning. Do not rely on the preview as the sole basis for legal, financial, employment, insurance, identity, safety, or other high-impact decisions. Verify the source and obtain appropriate professional or forensic review where the outcome matters.

You must have a lawful right to inspect any file you select and must not use KIR Verify to violate privacy, confidentiality, intellectual-property rights, or applicable law. The public preview is provided without a warranty that every manipulation or threat will be detected.

Intellectual property

The KIR Technology name, branding, website design, copy, graphics, and original materials are protected by applicable intellectual-property laws. You may view and share links to the website, but may not reproduce substantial content for commercial use without permission.

Ownership of project deliverables is stated in the applicable agreement. Unless agreed otherwise, any transfer of bespoke deliverables takes effect only after full payment. KIR retains its pre-existing tools, reusable methods, know-how, and generic components. Third-party and open-source materials remain subject to their own licence terms.

Third-party services

The website may link to or rely on third-party services. Their availability and terms are controlled by their respective providers.

Liability

To the extent permitted by law, KIR Technology is not responsible for indirect loss arising solely from use of this informational website. Nothing in these terms excludes liability that cannot legally be excluded.

Service-specific warranties, remedies, liability limits, and insurance requirements must be recorded in the applicable service agreement. Nothing in these website terms excludes liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or another liability that cannot lawfully be limited or excluded.

Governing law

These website terms are governed by the law of England and Wales. The courts of England and Wales will have jurisdiction, except where mandatory consumer law gives an individual the right to bring a claim elsewhere. Project agreements may contain their own governing law and dispute-resolution terms.
